These Terms of Service (“Terms”) form a legal agreement between you and El Houcine Idousaid, operating GIA.ac from Biougra, Morocco (“GIA.ac,” “we,” “us,” or “our”).

The Services are not offered to persons under 18, including with parental or guardian consent.

You are responsible for ensuring that your use of the Services is lawful in the jurisdiction from which you access them.

GIA.ac may require identity, account, or payment verification where reasonably necessary to protect the Services, prevent fraud, process legal requests, or comply with applicable law.
GIA.ac provides tools that use artificial intelligence and software-development technologies to help users plan, generate, modify, preview, test, export, publish, and deploy software projects.
The Services may include:
Specific functionality may depend on your account, subscription plan, location, available providers, and technical environment.
Subject to these Terms, GIA.ac grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, professional, internal-business, client, and commercial application-development purposes.
This licence permits you to use GIA.ac to create, modify, publish, deploy, and commercially exploit projects generated for you, subject to:

These restrictions apply to the GIA.ac platform and do not prevent you from modifying or commercially using project output generated for you under these Terms.
GIA.ac retains all rights in and to:
Except for the limited licence granted by these Terms, no ownership rights in the GIA.ac platform are transferred to you.
You retain ownership of content you submit to the Services, including:
These materials are referred to as “User Inputs.”
You grant GIA.ac a limited, worldwide, non-exclusive licence to host, copy, process, transmit, display, and technically modify User Inputs only as reasonably necessary to:
This licence ends when the relevant User Inputs are deleted from GIA.ac’s active systems, subject to reasonable backup, legal, security, and fraud-prevention retention.
GIA.ac does not acquire ownership of your User Inputs.
“Output” means code, text, designs, configurations, files, plans, and other materials generated by the Services in response to your User Inputs.
As between you and GIA.ac, and to the extent permitted by applicable law:

Where GIA.ac-owned reusable components are included in your generated project, GIA.ac grants you a perpetual, worldwide, non-exclusive, royalty-free licence to use, modify, distribute, and deploy those components only as part of or in connection with your generated project.
Output may include open-source software or third-party components. Those components remain governed by their applicable licences and terms.
Because artificial-intelligence systems may generate similar material for different users, GIA.ac does not guarantee that Output will be unique.
Nothing in these Terms grants you ownership over output generated independently for another user.
You represent that you have the necessary rights and permissions to submit your User Inputs and use them through the Services.
You are responsible for reviewing your generated project before publishing, deploying, distributing, selling, or relying on it.
This includes reviewing, as applicable:
You must not include passwords, private keys, access tokens, or other secrets in public projects, client-side source code, or publicly shared content.
GIA.ac is not the operator, publisher, employer, merchant, healthcare provider, financial institution, legal adviser, or data controller of an application merely because that application was generated using GIA.ac.
You are responsible for operating your generated application and for complying with laws applicable to its purpose, users, content, and data processing.
The Services use artificial intelligence to generate, modify, analyze, and repair software and related content.
Artificial-intelligence output may:
You must use appropriate human review, testing, security checks, and professional judgment before relying on Output in production or for high-impact purposes.
GIA.ac does not guarantee that every Output will be:
GIA.ac will make reasonable efforts to provide the functionality described for the applicable plan, but no AI system can guarantee perfect results in every case.
You must not rely on GIA.ac as a substitute for legal, medical, financial, accounting, security, or other regulated professional advice.
GIA.ac may provide an interactive preview that allows you to inspect and test a generated project before downloading, exporting, publishing, or deploying it.
You are responsible for using the available preview and reviewing the project before accepting delivery.
A preview may not reproduce every characteristic of the final production environment. Differences may result from:
By downloading, exporting, publishing, deploying, or transferring a project, you confirm that you had a reasonable opportunity to inspect the available preview and accept delivery of the project in its then-current state, subject to any mandatory legal rights that cannot be excluded.
Except where required by applicable law, fees paid for a generated project are final and non-refundable once you have:
This policy applies because GIA.ac provides an opportunity to inspect the available preview before project delivery.
After delivery, the following do not normally create a right to a refund:
This section does not remove any mandatory rights or remedies that cannot lawfully be excluded.
Where a digital project or service is materially defective, not provided as described, or otherwise fails to conform to mandatory requirements, you may be entitled to correction, replacement, continued performance, a proportionate price reduction, termination, reimbursement, or another remedy required by applicable law.
GIA.ac may first be entitled to a reasonable opportunity to correct a remediable problem before a refund or price reduction is required.
Cancelling or terminating an account does not create a right to a refund for projects already downloaded, exported, published, deployed, or otherwise delivered, except where applicable law requires otherwise.
Consumers may have a statutory right to withdraw from certain distance contracts within a specified period.
Where applicable law permits immediate performance of a digital service or immediate supply of digital content, GIA.ac may ask you separately to:
Acceptance of these Terms alone does not replace a separate consent where applicable law requires one.
Any mandatory withdrawal, cancellation, conformity, or refund rights available under applicable consumer law remain unaffected.
Some Services may be offered free of charge, while others may require a one-time payment, subscription, usage credit, or other fee.
The applicable price, billing interval, included usage, taxes, and material plan limitations will be displayed before purchase.
By purchasing a paid Service, you authorize GIA.ac and its payment provider to charge the selected payment method for the amounts disclosed during checkout.
You agree to provide accurate and current billing information.
Where a subscription renews automatically:
Unless required by law or stated otherwise at purchase, cancelling a subscription does not provide a refund for the current billing period.
Usage limits and credits may depend on your plan.
Credits:
Where a generation fails because of a verified GIA.ac system failure, GIA.ac may restore the affected credit or provide another appropriate remedy.
GIA.ac may change prices for future purchases or renewal periods.
Material subscription price changes will be communicated in advance where required by law. A price change will not apply retroactively to a completed billing period.
If a payment fails or remains unpaid, GIA.ac may restrict paid functionality or suspend the affected account after providing appropriate notice where practical.
The Services may integrate with or depend on third-party providers, including:
Third-party services are governed by their own terms, privacy policies, availability, and technical limitations.
GIA.ac does not control third-party services and is not responsible for failures caused solely by those services, except to the extent GIA.ac remains responsible under mandatory law.
You are responsible for:
GIA.ac may replace, limit, suspend, or discontinue a third-party integration where reasonably necessary for security, availability, legal compliance, provider compatibility, or product development.
You must not use the Services to:
You remain responsible for User Inputs, generated projects, and applications you publish or deploy.
Where GIA.ac allows you to publish or share a project, information included in that project may become available to other users or the public.
Do not publish:
You control whether your project is made public, except where a feature is clearly presented as public by design.
GIA.ac may remove or restrict access to public content where reasonably necessary to:
Reports concerning allegedly unlawful or infringing content may be sent to support@gia.ac and should include enough information to identify and evaluate the reported material.
Where required by applicable law, GIA.ac will provide relevant notices, reasons, or redress mechanisms concerning content restrictions.
If you believe that content available through GIA.ac infringes your copyright or another intellectual-property right, contact support@gia.ac.
Your notice should include:
GIA.ac may request additional information before taking action.
GIA.ac may remove or restrict material and may suspend repeat infringers where appropriate.
You must not attempt to:
GIA.ac uses reasonable technical, administrative, and organizational safeguards, but no online system can guarantee absolute security.
You are responsible for securing your account, generated project, deployment environment, connected services, and credentials.
Security concerns may be reported to support@gia.ac. Do not publicly disclose an unremediated vulnerability in a manner that creates avoidable harm.
GIA.ac’s collection and use of personal information is described in the GIA.ac Privacy Policy.
Users who operate applications generated through GIA.ac are responsible for determining and fulfilling their own privacy and data-protection obligations.
Depending on the application, this may include:

GIA.ac aims to provide reliable Services but does not guarantee uninterrupted or error-free availability.
The Services may be temporarily unavailable because of:

Where a material change adversely affects a paid subscription, GIA.ac will provide reasonable notice where practical and any remedy required by applicable law.

You may cancel an eligible subscription through available account controls or by contacting support@gia.ac.
GIA.ac may suspend or terminate access immediately where reasonably necessary because of:
For other material breaches that are reasonably capable of correction, GIA.ac may provide notice and a reasonable opportunity to remedy the breach before termination.
Termination or suspension resulting from your breach does not create a right to a refund, including where you have already downloaded, exported, published, deployed, or otherwise received a project, except where applicable law requires otherwise.
Upon termination:
You should export any projects you wish to retain before closing your account.
Provisions that by their nature should survive termination will remain effective, including provisions concerning ownership, delivered Output, payments, disclaimers, liability, indemnification, and dispute resolution.
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
GIA.ac does not warrant that:
These disclaimers do not exclude warranties, guarantees, remedies, or consumer rights that cannot lawfully be excluded.
Nothing in these Terms excludes or limits liability for:

This obligation does not apply to the extent a claim results from GIA.ac’s own breach, negligence, intentional misconduct, or violation of applicable law.
This section does not apply to a consumer where, or to the extent, consumer indemnification is prohibited or restricted by mandatory law.
These Terms are governed by the laws of the Kingdom of Morocco, without regard to conflict-of-law principles.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections available under the law of your country of residence.
Before commencing formal proceedings, you and GIA.ac agree to make a reasonable good-faith effort to resolve the dispute by contacting support@gia.ac.
For business users, the competent courts of Biougra, Morocco will have exclusive jurisdiction over disputes arising from these Terms, unless GIA.ac and the business user agree otherwise in writing.
Consumers may bring proceedings before any court that has jurisdiction under applicable mandatory law.
Nothing in these Terms limits a right to use an applicable consumer-protection authority, alternative dispute-resolution procedure, or other remedy that cannot lawfully be excluded.
GIA.ac may update these Terms to reflect changes in:
The updated Terms will be posted with a revised effective date.
Where a change is material, GIA.ac will provide reasonable advance notice through the Services or by email where required.
Changes will apply from the stated effective date and will not apply retroactively unless required by law.
If you do not agree to updated Terms, you must stop using the Services and cancel any affected subscription before the changes take effect.
These Terms, the Privacy Policy, and any plan-specific terms presented at purchase constitute the agreement between you and GIA.ac concerning the Services.
If a provision is found invalid or unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will continue in effect.
Failure to enforce a provision does not waive the right to enforce it later.
You may not assign your rights or obligations under these Terms without GIA.ac’s written consent.
GIA.ac may assign these Terms in connection with a restructuring, incorporation, merger, acquisition, financing, or transfer of the Services, provided that your mandatory rights are not reduced.
These Terms do not create an employment, partnership, agency, franchise, or joint-venture relationship between you and GIA.ac.
